  2. PLEASE READ THIS PRODUCT LICENCE (THIS LICENCE) CAREFULLY.  BY 
  3. USING THE SOFTWARE AND CLICKING THE "YES" ICON BELOW, YOU ARE 
  4. ACKNOWLEDGING THAT YOU HAVE READ AND UNDERSTOOD THIS LICENCE 
  5. AND THAT YOU AGREE TO BE BOUND BY ITS TERMS.  IF YOU DO NOT AGREE 
  6. TO THESE TERMS, YOU MAY CLICK THE "NO" ICON BELOW AND 
  7. PROMPTLY RETURN THE UNUSED SOFTWARE AND ALL RELATED MATERIALS

  10. 1.    COPYRIGHT
  11. Copyright in the Product (which shall mean this one copy of the software and any 
  12. accompanying electronic files and printed materials) and every part of the Product is 
  13. owned by Virgin Interactive Entertainment (Europe) Limited (Virgin) and/or its 
  14. suppliers and is protected by copyright law.

  16. 2.    GRANT OF LICENCE
  17. Virgin hereby grants you (being either an individual or other legal entity), the end user, 
  18. the limited, non-transferable right to use the Product on any single computer only for your 
  19. personal use and enjoyment and subject to the terms herein.  This Licence is your proof of 
  20. licence to exercise the rights granted herein and must be retained by you. Virgin may 
  21. terminate this Licence immediately if you fail to comply with any of the terms of this 
  22. Licence.

  24. 3.    RESTRICTIONS
  25. Virgin retains all rights not expressly granted herein.  You must therefore treat the 
  26. Product like any other copyright material (e.g. a book or musical recording) except that to 
  27. the extent that the Product is software you may either (a) make one copy of the Product 
  28. solely for backup or archival purposes, or (b) transfer the Product to a single hard disk 
  29. provided you keep the original solely for backup or archival purposes. Further, if the 
  30. Product contains a map or level editor, you may use the editor in accordance with the 
  31. instructions in the accompanying documentation to create maps or levels for your 
  32. personal use and enjoyment, and you may allow others to use such maps or levels for their 
  33. personal use and enjoyment, but in no event may such maps or levels be exploited 
  34. commercially in any manner, by you or any other individual or legal entity.  You may not 
  35. copy the written materials accompanying the Product.
  36. The Product is licensed to you only for your personal use and enjoyment and may not be 
  37. used for any commercial purpose whatsoever.  You may not loan, rent, lease, give, sell, 
  38. offer for sale, sub-licence or otherwise transfer the Product or any portion of the Product 
  39. or anything incorporated therein, including any screen display, sound or accompanying 
  40. documentation, to any third party, nor may you permit any other person to use the Product 
  41. in exchange for remuneration.  Further, you may not place the Product on a computer 
  42. system that would allow multiple users to access it.  Notwithstanding the foregoing, you 
  43. may transfer your rights under this Licence on a permanent basis provided you transfer 
  44. this Licence and the Product, including all accompanying printed materials, while 
  45. retaining no copies, and the recipient agrees to be bound by the terms of this Licence.  If 
  46. the Product is an update, any transfer must include this update and all prior revisions.
  47. Save to the extent permitted by law you may not copy, modify, adapt, translate, create 
  48. derivative works of, publicly perform, publicly display, distribute, transmit, decompile, 
  49. disassemble, or attempt to derive source code from, all or any portion of the Product or 
  50. anything incorporated therein, including any screen display, sound or accompanying 
  51. documentation, or permit or encourage any third party to do so.
  52. Without limiting the generality of the foregoing restrictions, specifically you may not 
  53. offer the Product on a pay-per-play basis or on a computer system or network to which 
  54. you lease or rent access to others, electronically distribute the Product, or any portion of 
  55. the Product or anything incorporated therein, including any screen display, sound or 
  56. accompanying documentation.

  58. 4.    LIMITED WARRANTY
  59. You expressly acknowledge and agree that use of the Product is at your sole risk. Virgin 
  60. warrants that the software will perform substantially in accordance with the 
  61. accompanying written materials for a period of ninety (90) days from the date of the 
  62. ProductÆs initial purchase.  No dealer, distributor, agent or employee of Virgin is 
  63. authorised to make any modification or addition to this warranty.

  65. 5.    NO OTHER WARRANTIES
  66. Virgin disclaims all other warranties, express, implied or, to the extent permissible by 
  67. law, statutory, including all warranties of satisfactory quality, fitness for a particular 
  68. purpose and non-infringement, with respect to the Product. Virgin does not warrant that 
  69. the Product will satisfy the requirements of your computer system or that the Product is 
  70. without defect or error or that the operation of the Product will be uninterrupted.
  71. NOTHING IN THIS LICENCE WILL AFFECT YOUR STATUTORY RIGHTS IF YOU
  72. ARE A CONSUMER UNDER ANY APPLICABLE STATUTE

  74. 6.    CUSTOMER REMEDIES
  75. VirginÆs entire liability and your exclusive remedy shall be, at VirginÆs option, either (a) 
  76. return of the price paid for the Product or (b) repair or replacement of the Product that 
  77. does not meet the limited warranty set forth in Section 4 of this Licence, provided that it 
  78. is returned to Virgin with proof of purchase.  The limited warranty set forth in Section 4 
  79. of this Licence is void if failure of the Product has resulted from accident, abuse, 
  80. misapplication or any wrongful or negligent act by you.  Any replacement of the Product 
  81. will have the same limited warranty and this will last for the remainder of the original 
  82. warranty period or thirty (30) days, whichever is longer.

  84. 7.    LIMITATION OF LIABILITY
  85. In no event shall Virgin be liable for any damages whatsoever (including, without 
  86. limitation, consequential, special, indirect, direct, incidental, loss of business profits, 
  87. business interruption, loss of business information, or other pecuniary loss) arising out of 
  88. the use of the Product, even if Virgin has been advised of the possibility of such damages.  
  89. In no event shall VirginÆs liability by operation of law, if any, be greater than the price 
  90. you paid for the Product.

  92. 8.    GENERAL
  93. This Licence sets forth the entire agreement between Virgin and you with respect to the 
  94. subject matter hereof and supersedes all prior negotiations, understandings and 
  95. agreements, whether written or oral, between Virgin and you concerning the subject 
  96. matter of this Licence.
  97. This Licence shall be governed and interpreted in accordance with the laws of England 
  98. and you specifically agree to submit to the non-exclusive jurisdiction of the English 
  99. Courts.  Should any provision of this Licence be held to be void, invalid, or inoperative, 
  100. the remaining provisions hereof shall not be affected and shall continue in effect as 
  101. though such unenforceable provision(s) have been deleted from this Licence.  No failure 
  102. or delay by Virgin in exercising any right, power, or remedy hereunder shall operate as a 
  103. waiver or any such right, power, or remedy.
